Maxwell Privacy Policy

Maxwell “the App” provides an abandoned cart messaging service “the Service” to merchants who use Shopify to power their stores. This Privacy Policy describes how personal information is collected, used, and shared when you install or use the App in connection with your Shopify-supported store.

Personal Information the App Collects

When you install the App, we are automatically able to access and modify certain types of information from your Shopify account:

Additionally, Maxwell may collect a variety of information, such as user data when a user / visitor engages with one of Maxwell’s Chatbots or Website (“User”). This can be for example when a User engages with a Maxwell Chatbot on Facebook Messenger. We will store the input given by the User and his or her personal details (e.g. name, profile picture, ID, interests). The type of information stored solely depends on what the “owner” of the chatbot wants to know from his / her User / Visitor and what information is subsequently provided. Users are responsible for the personal information they choose to share or submit in these instances.

Furthermore, Maxwell automatically collects meta information when a User engages with one of Maxwell’s Chatbots, or when a Visitor visits the Maxwell website (“Visitor”). For example, Maxwell may log browser information (such as IP Address, browser type, operating system, viewport, language [and web pages visited]), and mobile device information. The Maxwell website includes a Facebook Login Feature. This Feature may collect a variety of information, such as ID, Name, and Email to enable the Feature to function properly. This Feature is hosted directly by Facebook and available on our website. Interactions with this Feature are governed by the privacy policy of Facebook Inc.

We collect personal information directly from the relevant individual, through your Shopify account, or using the following technologies: “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org. “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps. “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.

How Do We Use Your Personal Information?

We use the personal information we collect from you and your customers in order to provide the Service and to operate the App. Additionally, we use this personal information to: Communicate with you; Optimize or improve the App; and Provide you with information or advertising relating to our products or services.

HOW IS INFORMATION PROTECTED?

Maxwell uses reasonable measures to protect the information stored within Maxwell’s databases, and Maxwell restricts access to such information to those employees who need access to perform their job functions, such as customer service personnel and technical staff. Maxwell has adopted physical, technological, and administrative measures to safeguard and secure the information.

Maxwell accounts are secured by a user created account, in which case reasonable precautions are taken to ensure that account information is kept private. The Maxwell account holder is responsible for keeping this password confidential and changing the password periodically.

All data transactions between the Maxwell account holders and the Maxwell infrastructure will be encrypted using SSL technology. Despite these efforts, please note that Maxwell cannot ensure or guarantee the security of information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of information at any time. Maxwell does not accept liability for unintentional entry, use, or disclosure of information.

These measures comply with the Guidelines Security of Personal Data and article 32 of the GDPR. As such, Maxwell shall provide full and timely assistance to its duty to answer and follow up on any request of data subjects regarding the exercise of the rights inserted in article 7.1 and article 32 to 36 of the GDPR.

Sharing Your Personal Information

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

Behavioural Advertising As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example, if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

DATA RETENTION

Maxwell will retain personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. For example, when you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

CHANGES

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
